EU Mandatory Energy Audits (EED)

The EU equivalent of the UK's ESOS: mandatory energy audits under the Energy Efficiency Directive. If you operate across the EU, this is the obligation you plan around, Article 8 of the 2012 directive and Article 11 of the 2023 recast.

What it is

The mandatory energy audit sits in the EU Energy Efficiency Directive: Article 8 of Directive 2012/27/EU, recast and strengthened as Article 11 of Directive 2023/1791/EU. Each member state transposes it into national law, so the exact form varies by country, but the core obligation is the same: large energy users must audit their energy use on a regular cycle, or run a certified energy management system instead.

Who is affected

The recast directive moved from company size to energy consumption thresholds, measured as the average annual consumption across all energy carriers over the previous three years:

  • Above 85 TJ per year: the enterprise must implement an energy management system.
  • Above 10 TJ per year, and not running an energy management system: the enterprise must carry out an energy audit.
  • A certified ISO 50001 energy management system that covers the audit requirements is treated as compliant.

Deadlines

DateWhat happens
11 October 2025Transposition deadline: member states must have the recast in national law.
11 October 2026First energy audit must be carried out by enterprises above the 10 TJ threshold, then at least every four years.
11 October 2027Energy management system must be in place for enterprises above the 85 TJ threshold.

National transpositions

The directive is enforced through national law, and the detail differs by country:

  • Spain: Real Decreto 56/2016, the auditoria energetica obligatoria, audits on a four-year cycle.
  • Germany: the Energiedienstleistungsgesetz (EDL-G), audits to DIN EN 16247-1.
  • France: the audit energetique reglementaire for large enterprises.
  • Other member states apply their own transposing legislation, aligned to the directive.

What we deliver

An EED energy audit readiness review: we confirm whether your enterprise is over the threshold, which national rules apply, whether the ISO 50001 route is the better option, and the audit or management-system deadline you are working to. Where a full audit is required, it is delivered with a partner engineer licensed in the relevant member state. See the EU Energy Audit Readiness Review for the scope, timeline and price, or the UK ESOS guide if you operate in the UK.

What happens if you do nothing

Penalties are set by each member state and range from fixed fines to consumption-based penalties. Missing the audit or management-system deadline also removes a defence in wider ESG and lender due diligence. The specific figure for your country is confirmed in the assessment.

How this compares to UK ESOS

ESOS is the UK scheme, based on organisation size, with a Phase 4 deadline of 5 December 2027. The EU obligation is based on energy consumption thresholds and is transposed country by country. If you operate in both, you plan for both.

Not sure if you are over the threshold?

Tell us your annual energy consumption and where you operate. We will tell you whether the audit or the energy management system applies, which national rules govern it, and the deadline that matters.
