Understanding MEES

The Minimum Energy Efficiency Standards (MEES) Regulations (SI 2015/962, as amended) prohibit the letting of domestic and non-domestic properties in England and Wales below a minimum EPC rating.

For non-domestic (commercial) properties, landlords have been prohibited from granting new leases for properties rated below EPC E since April 2018. From 2028, the target minimum for commercial properties is expected to increase to EPC C.

MEES does not currently apply to owner-occupied properties or buildings exempt from EPC requirements. Exemptions are available but must be registered on the national exemptions register and have a maximum validity of 5 years.

All landlords of non-domestic properties in England and Wales letting above the de minimis floor area threshold.

Residential Landlords

Landlords of domestic properties in the private rented sector — EPC E minimum has applied since April 2020.

Investors & Lenders

Commercial real estate investors must account for MEES compliance risk in acquisition due diligence and loan underwriting.


Key requirements

EPC E Minimum — Commercial

Non-domestic properties must be rated EPC E or above for any new or renewed letting. Properties rated F or G cannot legally be let.

EPC C Target — 2028

Government policy targets EPC C as the minimum for commercial lettings from 2028 — significant retrofit investment required for current D/E stock.

Exemptions Register

Landlords claiming exemption must register on the PRS Exemptions Register with supporting evidence. Exemptions last 5 years maximum.

Enforcement

Local authorities can issue compliance notices and financial penalties — up to £150,000 for non-domestic properties let in breach of MEES.
